The green card is for those with an exceptional ability. The best option for applicants who can prove remarkable ability in their fields is the EB-1A Green Card. The Basic

The EB-1
For applicants who have been acknowledged as great in their field,  this categorization is ideal. The candidate must meet three of the ten requirements listed below to be eligible:
1. Have you ever won any prestigious medals or accolades for achievement in a particular field of endeavor that are recognized nationally or internationally?
2. Do you belong to organizations that demand extraordinary accomplishments from their members, as determined by reputable national or international experts?
3. Do you have any published information about you that is related to your work in the sector in prominent professional, trade, or media outlets?
4. Have you ever taken part in a panel or judged someone else’s work in the same or a related field of specialization?
5. Have you produced significant original contributions to science, academia, or business?
6. Do you have any experience writing scholarly articles for big publications?
7. Has your work been shown in exhibitions or showcases for the arts?
8. Have you worked for a reputable organization in a key or leadership position?
9. In relation to other professionals in your area, do you now or will you command a high wage or other form of payment for your services?
10. Have you experienced artistic or financial success?

GUIDELINES

In the EB1 category, the EB-1A is a permanent immigrant visa reserved for foreign workers with remarkable ability in the sciences, business, arts, education or athletics which has been demonstrated by sustained national or international praise. For people who are recognized as being at the very top of their field and who are coming to the United States to keep working in that field, the EB-1 extraordinary ability classification is perfect for them.

Requirements for the EB-1A visa

You must have achieved achievements that have been acknowledged in your field in order to be eligible for an EB-1A visa. There are two ways to meet these requirements: 

(1) You must have won a significant and globally renowned prize, such as the Nobel Prize, or (2) You must have fulfilled at least three of the ten criteria listed below, and when taken as a whole, all of your evidence must demonstrate that you are among the selected group of people who have attained the pinnacle of their profession.
These requirements are as follows:

1. Possess a significant medal or award that is nationally or internationally renowned.
2. Inclusion in organizations that demand exceptional performance (as judged by recognized experts)
3. Prominent publications (authored by others) that discuss you and your work
4. Serve as a reviewer of other people’s work in your field.
5. Significant achievements in your field
6. Authorship of academic publications or articles
7. Exhibitions or displays of artistic work
8. Plays a crucial or leading position for prestigious organizations
9. A high wage or other compensation (compared to others in the field)
10. The success of performing arts businesses

Qualifications in Detail:

1. How do I prove that I have received a significant prize or award that is nationally or internationally renowned?

Documentation detailing the requirements for winning the award, the value of the honor, the standing of the organization or panel, the judging procedure, prior winners, the number of awards given each year, and a copy or photograph of the award are all acceptable forms of evidence.

 

2. How to prove that you belong to organizations that demand exceptional success (as judged by recognized experts)
Ordinary membership is not thought to be beneficial in a group that is simple to join because it does not call for exceptional achievement. The following documents may be submitted as evidence to meet this requirement: 

(a) Documents outlining the association’s mission, scope, goals, target membership, and standing in the national or international community; 

  (I) Documents outlining the qualifications and criteria for membership; and 

   (ii) Other pertinent requirements for membership.

3. How to provide evidence of substantial third-party writings about you and your work that have been published. 

Date, material’s title and author, and any appropriate translations should all be included in the evidence. 

 

Additional supporting documentation should consist of copies of publications, documents attesting to the importance of the published materials, information on how often and how many copies of the publication were distributed, and any additional published materials. For instance, stories mentioning a candidate’s research or achievements on news websites like CNN, MSNBC, Yahoo!, etc. or expert news websites like ScienceDaily, NewsRX, etc.

4. How can you show that you have served as a judge of others’ work in your field?
Documents that can satisfy this condition. (i) details on the selection criteria for each judge; (ii) an explanation of how and why you were chosen to serve as a judge.

5. How can you show significant contributions to your field?
Evidence of significant original contributions to the field’s science, literature, arts, sports, or business. Typically, letters of recommendation from impartial professionals who can speak about our accomplishments and their importance in the field serve as a great proof.

6. How can authors of scholarly papers in reputable journals or other important media be proven?
The following proof can be provided to prove that you wrote an academic article: Affidavits, letters, and other publications that illustrates the significance and value of the articles in the area; proof that the work was mostly your own creation; and the importance of the professional or trade publication, or other significant media where your scholarly paper was published.

7. How can you prove that your work has been seen at exhibitions or showcases of the arts? 

Some examples of proof to present to support these requirements include:

(a) Records attesting to your authorship of the displayed work;

(b) Records attesting to the venue’s (virtual or otherwise) status as an artistic display or exhibition;

(c) Copies of advertising materials that include distribution details
8. How can you prove that you have held a position of authority or importance for a reputable organization?

Letters and documents attesting to the leadership or crucial position, as well as details about the organization or establishment’s illustrious reputation are some examples of proof that must be given to support these criterion. Additionally, any records that demonstrate a significant contribution in a crucial or important position

9. How can you show that you are paid more than others in your field?
You may provide evidence in the form of copies of employment contracts, tax returns, or payroll records, as well as documentation proving that you have received other sizable kinds of payment for your services.

10. How can you show that your performing arts business is successful?
Box office receipts, sales of records, cassettes, CDs, and videos are some examples of proof that can be provided to support these requirement. This standard applies to actors, musicians, performers, and vocalists.

Method for Filing

The petition is submitted on form 1-140, Immigrant Petition for Alien Worker, the petition and the necessary supporting documentation are received by the U.S. Citizenship and Immigration Services’ relevant Service Center.

Benefits of EB-1A

The benefits of the EB-1A category for aliens with exceptional talent include:

• Does not demand a commitment to a long-term position in the US.

• To acquire a green card via the labor certification procedure, your spouse and children may also be granted permission to work and travel.

• More adaptable than the procedure for labor certification. You may be able to change employment sooner and may be able to transition to a far wider choice of career alternatives compared to the labor certification process.

• A self-petition is possible. In other words, no one at the college or workplace where you work needs to sign the petition.

 EB-1A disadvantages

The following drawbacks pertain to the EB-1A category for aliens of remarkable ability:

• You must be exceptional, not just good, and sadly, not everyone is eligible.                                                                                                               

• Though the labor certification procedure isn’t always highly predictable, it can be less predictable than cases that are filed through that method.

 

Speedy processing

The EB-1A is incredibly quick compared to other employment-based green cards and it exempts the application from the drawn-out perm process.

 

Benefits/challenges

 

Benefits:

• Quick processing: The PERM process is not necessary for obtaining an EB-1A green card.

• Sponsorship is not necessary: Inasmuch as the applicant must prove future work in the field, an employer-sponsor is not required
